STA Release Activity Disclaimer Guidance

STA have produced this guidance document to support open water coaches, swim schools, Approved Training Centres and its members, when creating an activity disclaimer.

An activity disclaimer is a document that participants read and sign, prior to undertaking an activity. By signing a disclaimer, participants are confirming understanding of the activity being undertaken, making any medical information known, acknowledging the risks involved, and releasing the provider from liability for any injuries or damages that may occur.

Note: Activity disclaimers do not discharge a provider of their legal duty of care to participants. Risk assessments, safe working procedures, staff training and qualifications, etc must be in place, undertaken and reviewed regularly.
